REFUND POLICY - THE EQ CODE LEADERSHIP LAB
Due to the nature of personal development programs, clients will not receive any refund on the Program materials, for any and all reasons. Be aware that this contract constitutes a financial commitment for the entire amount of the Program, regardless of how much of the Program the Client completes.

TERMINATION POLICY - THE EQ CODE RELATIONSHIP LAB MONTHLY MEMBERSHIP
The EQ Code Relationship Lab is a monthly subscription. While our monthly membership rates may increase at any time, your monthly rate is guaranteed for a period of 12 months.
You may cancel membership in the monthly program anytime at least 7 business days before your next billing date to avoid being charged for that month. You will receive a confirmation email as a receipt of the cancellation request. Once the cancellation request has been processed, all access to the membership portal will be revoked and recurring billing cancelled upon completion of the current payment cycle.
We will not refund payments after the fact due to your failure to notify us.
Membership access is based on having an active and current membership. Access is granted as long as you are an active member.

Requests to cancel sent through social media and/or other avenues will not be honored.
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

We process this data to operate our website and ensure relevant content is provided to you, to ensure the security of our website, to maintain back- ups of our website and/or databases and to enable publication and administration of our website, other online services and business. We do not collect any Sensitive Data about you. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We do not collect any information about criminal convictions and offences.
Our lawful ground of processing your personal data to send you marketing communications is either your consent or our legitimate interests (namely to grow our business).
Under the Privacy and Electronic Communications Regulations, we may send you marketing communications from us if (i) you made a purchase or asked for information from us about our goods or services or (ii) you agreed to receive marketing communications and in each case you have not opted out of receiving such communications since. Under these regulations, if you are a limited company, we may send you marketing emails without your consent. However you can still opt out of receiving marketing emails from us at any time.
You can ask us or third parties to stop sending you marketing messages at any time simply by unsubscribing from emails via the unsubscribe button which can be found at the bottom of each email.
If you opt out of receiving marketing communications this opt-out does not apply to personal data provided as a result of other transactions, such as purchases, warranty registrations etc.

ORDERING PRODUCTS ON OUR SITE
We will request information from you on our order forms for purchase of products. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we’ll use this information to contact you.

To modify your email subscriptions, you can find an unsubscribe link at the bottom of each email. Please note that due to email production schedules you may receive any emails already in production. Please note that we may maintain information about an individual sales transaction in order to service that transaction and for record keeping.

This Agreement (“Agreement”) governs the policies and terms and conditions for the clients (“Clients) of the program (“Program”) created and facilitated by Shyamala Kiru Inc (the “Company”). By signing this Agreement you are acknowledging and confirming that you, the Client will abide by the terms and conditions set out in this Agreement.
The Program is a 6-month contract where the Program start date is defined as the date of enrolment, and where the program end date is defined as 6 months from that date.
After the Program is over the Client may have the opportunity to continue for additional time, where additional fees apply and will be discussed.
The Company has the right to modify the Program at any time for any reason and will ensure that the Client is provided with applicable updates if they are within the Program duration.
Portal Access: You receive access to THE EQ CODE online portal, which includes video materials as well as digital worksheets.
Group Calls: You will have access to weekly coaching calls. All coaching, including questions, feedback and support will happen during our coaching calls.
Exclusive Facebook Group: You will have access to the exclusive Facebook Group, where you can submit questions in between group calls.
The EQ Code is a group coaching program, not a clinical service. The EQ Code is not a substitute for medical or clinical care, including Psychotherapy services.
All program fees are subject to applicable taxes.
If the Client chooses the payment plan, they will be charged the initial payment at the time of enrolling, followed by instalments every 30 days for the remaining months, on the same day of the month.
If the Client chooses the payment plan, they are responsible for ensuring that their account remains in good standing for the entire duration of the Program.
If a payment is missed, the Client will have 5 business days to bring their account into good standing after the declined payment. If the account is not brought into good standing within 5 business days, the Client’s Program will be put on hold and access will be denied until the account is brought into good standing. Extensions will not be offered as a result of program holds due to late or missed payments.
If the account remains in poor standing for a duration of more than 30 business days, formal collections action will begin on any past due amounts.
There is a strict NO REFUNDS policy. No refunds of any kind will be issued for the program, including on deposits or on any partial payments.
The Client may terminate this Agreement at any time with 72 hours written notice via email. If the Client terminates the Agreement, the client remains financially responsible for the full cost of the Program and must immediately make any payments that are due. No refunds will be provided.
The Client understands that given the group nature of the Program, including the Facebook Group that any discussions or any related Program discussions are to be held in strict confidence and cannot be shared, referred to or mentioned outside of the designation Program Facebook Group.
“Intellectual Property” which includes information relating to the Program proprietary content, including but not limited to proprietary ideas, written content, graphic content, production data, and information regarding clients, copyrights and trade secrets remain the sole property of The Company.
Clients do not have any right to reproduce in part or in whole any Intellectual Property for gift, resale or license to a third party. Clients will not use any of the Program Intellectual Property for their own business venture or to be shared with friends, family, coworkers or anyone outside of the Program.
The Client will not, from the date of this Agreement or the date of Agreement and for a period of three years directly or indirectly solicit for employment or employ any person who is now employed or retained by the Company or any affiliate of the Company without the prior written consent of the Company.
The Client will not, from the date of this Agreement or the date of Agreement and for a period of three years directly or indirectly solicit any other Client from the Program to benefit their own business venture.
From time to time, the Client may be asked permission for use of Client likeness, program materials or files, video, audio, photos or marketing materials including presentations by the Company, to promote The EQ Code. The Company agrees it will not use aforementioned Client materials without express permission from the Client.
If the Client agrees, the Client authorizes the Company to use and publish materials as they see fit on social media, websites and other distribution media. The Client will not receive monetary or royalty fees. The Client waives any right to inspect or approve the finished product, including written copy, wherein the Client’s likeness or testimony for the program appears.
RELEASE OF LIABILITY
I agree to release and hold harmless The Company against any and all claims, suits or actions of any kind whatsoever and release liability, damages, compensation or otherwise brought on by me or anyone on my behalf, including any and all damages incurred from business operations. I acknowledge that The Company and The Program, their directors, coaches and any support staff are not responsible for errors, omissions, or failures to act and are not to be held liable and responsible in any way whatsoever for Client liability, errors and omissions as part of The Program.
DISCLAIMER OF WARRANTIES
The Company does not warrant, either expressly or by implication, any aspect of the Program nor is it responsible for the success of the Program. The Client confirms and agrees that they are wholly responsible for the progress and results and that the Program (and Company) offers no warranties or guarantees of results of any kind. The Company does not warrant or guarantee that the Client will achieve any level of result or success using any of the materials provided by or created by the Program.
In case any provision in this Agreement shall be held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect and shall not in any way be affected or impaired or invalidated.
This Agreement will be construed in accordance with and governed by the Laws of the Province of Ontario.
